1. Promoter and service provider
1.1 The Alpha One Improvement Guarantee is offered by Alpha One Coaching College Pty Ltd (ABN 17 634 367 196, ACN 634 367 196), referred to in these Terms as “Alpha One”, “we”, “us” or “our”.
1.2 Alpha One’s contact details are:

Email: bellavista@alphaonecollege.com.au

1.3 The Guarantee applies only to eligible Alpha One courses and Assessment Groups identified in the applicable Offer Schedule.
1.4 Alpha One remains responsible for administering the Guarantee even if tuition or administration is provided through an Alpha One branch or related entity.
2. Nature of the Guarantee
2.1 The Alpha One Improvement Guarantee is designed to give eligible new students an additional opportunity to consolidate their learning if they do not meet the applicable Improvement Target after one Offer Term.
2.2 If a Student satisfies all eligibility requirements but does not meet the Improvement Target, Alpha One will provide the applicable Holiday Theory Intensive described in these Terms and the Offer Schedule for free.
2.3 The Guarantee does not promise that every Student will achieve a particular academic result.
2.4 The Guarantee is not a cash-refund or money-back offer.
3. Offer Schedule
3.1 These Terms are intended to operate across different school terms.
3.2 The Offer Schedule identifies the dates, courses, Assessment Groups, assessment arrangements and Holiday Theory Intensive sessions applying to a particular promotion.
3.3 If there is an inconsistency between these Terms and an Offer Schedule, the Offer Schedule applies only to the extent necessary to resolve that inconsistency.

- “Parent”
- means the Student’s parent or legal guardian.
- “Student”
- means the child registered for the Guarantee.
5. Acceptance of these Terms
5.1 The Parent and Student accept these Terms when the Parent submits an enquiry through the Alpha One Improvement Guarantee landing-page form.
5.2 A separate signature, contract or acceptance checkbox is not required for the Guarantee.
5.3 By submitting the enquiry, the Parent confirms that:
- they are the Student’s parent or legal guardian, or are otherwise authorised to submit the enquiry;
- the information provided is complete and accurate; and
- they have read and accepted these Terms and the applicable Offer Schedule.
5.4 Submitting an enquiry does not require the Parent to enrol the Student after the free trial.
6. Eligible Students
6.1 The Guarantee is available only to a Student who is not currently enrolled in an Alpha One course when the Guarantee enquiry is submitted.
6.2 A former Alpha One Student who is no longer enrolled qualifies as a new Student for this requirement.
6.3 A Student who has previously completed only a free trial with Alpha One qualifies as a new Student for this requirement.
6.4 A new child from a family with another child already enrolled at Alpha One qualifies as a new Student for this requirement.
6.5 A Student who is currently enrolled at Alpha One is not eligible, including where the Student proposes to add or change courses.
6.6 A Student who qualifies under sections 6.2, 6.3 or 6.4 must still satisfy every other requirement in these Terms.
7. Enquiry and free trial
7.1 The Parent must submit an enquiry through the designated Improvement Guarantee landing-page form.
7.2 Alpha One will contact the Parent to help arrange the Student’s free trial class.
7.3 The free trial class must occur during the Student’s Commencement Week unless Alpha One approves another arrangement due to circumstances within Alpha One’s control.
7.4 A free trial does not create an obligation to enrol.
8. Activation of the Guarantee
8.1 The Student must complete both the free trial class and Initial Assessment during the Commencement Week.
8.2 The free trial and Initial Assessment may be completed in either order during the Commencement Week.
8.3 If the Parent chooses to enrol the Student after the trial and the Student otherwise satisfies these Terms, the Guarantee becomes active for the applicable Eligible Course and Assessment Group.
8.4 The Student must commence tuition in Week 1 or Week 2 of the Offer Term.
9. Fees
9.1 The Student must be enrolled for the full Offer Term.
9.2 All applicable tuition fees for the Offer Term must be paid in full by the required due dates.
9.3 Discounts and other promotional offers may be used with the Guarantee, subject to the terms applying to those offers.
9.4 If the Student withdraws or receives a refund of the applicable term fees before completing the Offer Term, the Student will no longer be eligible for the Guarantee, except where otherwise required by law or agreed by Alpha One.
10. Eligible Courses and Assessment Groups
10.1 The Eligible Courses are:
- Foundations;
- Intensive English Course, or IEC;
- WEMT;
- OCTT; and
- STTC.
10.2 The Assessment Groups are:
- Intensive English — IEC;
- Foundations — Foundations;
- Theory — WEMT; and
- Trial Test — OCTT and STTC.
10.3 A Student may participate in more than one Assessment Group if enrolled in the relevant Eligible Courses and all requirements are satisfied separately for each group.
10.4 Courses within the same Assessment Group may be measured together for the purpose of the Guarantee.
11. Attendance requirement
11.1 The Student must attend at least nine classes during the Offer Term for every Eligible Course relevant to their claim under the Guarantee.
11.2 An Alpha One-approved replacement class attended online or in person may count towards this requirement.
11.3 Receiving class materials or recordings without attending a class does not count as attendance.
11.4 A class missed by the Student does not count towards the nine-class requirement.
11.5 Alpha One does not ordinarily cancel scheduled classes. If an operational issue within Alpha One’s control would prevent the Student from having the opportunity to attend nine classes, Alpha One will offer a reasonable replacement class or make an appropriate adjustment to the attendance requirement.
12. Homework
12.1 Alpha One strongly recommends that Students complete all assigned homework because regular practice is important to academic improvement.
12.2 Homework completion is not an eligibility requirement under the Guarantee and will not be manually verified when determining the Student’s entitlement.
13. Initial Assessment
13.1 The Initial Assessment will ordinarily be provided by email and completed at home through the FlexiQuiz platform.
13.2 The Initial Assessment must be completed during the Student’s Commencement Week.
13.3 The Initial Assessment must be completed by the Student whose name is recorded in the enquiry.
13.4 Unless Alpha One approves a replacement because of a genuine technical or administrative issue, the first valid completed attempt will be used.
13.5 The Initial Assessment establishes the Student’s starting score for the relevant Assessment Group.
14. Initial-score eligibility
14.1 The Student’s unrounded Initial Assessment score must be 85.0% or lower to be eligible for the Guarantee in that Assessment Group.
14.2 A Student whose unrounded Initial Assessment score is higher than 85.0% is not eligible for the Guarantee in that Assessment Group.
14.3 Eligibility is assessed separately for each Assessment Group.
15. Final Assessment
15.1 The Final Assessment may be:
- the ordinary end-of-term test for the applicable course, completed in person during Week 9 or Week 10; or
- a separate assessment provided by email and completed through FlexiQuiz.
15.2 Alpha One will identify the Final Assessment method applicable to each course or Assessment Group.
15.3 Where the Final Assessment is the course’s in-class end-of-term test, the Student must complete it at the scheduled class or at an Alpha One-approved replacement sitting.
15.4 Where the Final Assessment is not an in-class end-of-term test, the Student must complete the FlexiQuiz Final Assessment within seven calendar days after their final attended class in the relevant Assessment Group.
15.5 If more than one Eligible Course contributes to the same Assessment Group, the seven-day period begins after the Student’s latest final attended class for those courses.
15.6 Unless Alpha One approves a replacement because of a genuine technical or administrative issue, the first valid completed attempt will be used.
16. Comparable assessments
16.1 The Initial and Final Assessments will assess substantially comparable skills and learning areas.
16.2 Questions may use different wording, numbers, examples or presentation while assessing the same underlying skills.
16.3 The Final Assessment does not have to repeat the exact questions contained in the Initial Assessment.
17. Improvement Target
17.1 Improvement is measured by comparing the Student’s unrounded Initial Assessment score with their unrounded Final Assessment score.
17.2 The required improvement is:
| Unrounded Initial Assessment score | Improvement Target |
|---|---|
| 0.0% to 50.0%, inclusive | An increase of at least 10.0 percentage points |
| Above 50.0% and up to 85.0%, inclusive | An increase of at least 5.0 percentage points |
| Above 85.0% | Not eligible for the Guarantee |
17.3 An increase is measured in percentage points, not as a percentage of the Initial Assessment score.
17.4 Meeting the exact applicable threshold counts as meeting the Improvement Target.
17.5 Scores may be displayed to one decimal place for communication purposes, but eligibility and improvement calculations will use the underlying unrounded scores.
17.6 If the Student’s improvement is below the applicable Improvement Target, the Student has not met the Improvement Target.
18. Technical issues and exceptional circumstances
18.1 The Parent must notify Alpha One as soon as reasonably possible if a genuine technical issue prevents the Student from completing an assessment correctly or by the required deadline.
18.2 Alpha One may request reasonable evidence of the issue.
18.3 Where satisfied that a genuine technical or administrative issue occurred, Alpha One may provide a replacement link, approve another attempt or make another reasonable arrangement.
18.4 Alpha One will reasonably consider exceptional circumstances affecting a Student’s ability to satisfy a procedural requirement, but is not required to waive academic, attendance or payment requirements unless required by law.
19. Assessment integrity
19.1 Each assessment must represent the Student’s own genuine attempt.
19.2 A Parent or another person must not:
- tell or encourage the Student to answer questions incorrectly;
- deliberately cause the Student to leave questions unanswered;
- complete answers on the Student’s behalf;
- provide unauthorised assistance; or
- otherwise manipulate an assessment result.
19.3 Alpha One may investigate where it has reasonable grounds to believe an assessment was not a genuine attempt.
19.4 Alpha One may ask the Parent or Student for an explanation or require a supervised or replacement assessment where reasonably necessary to verify the result.
19.5 Alpha One will not exclude a Student solely because of an unsupported suspicion.
19.6 If Alpha One reasonably determines, based on available evidence, that an assessment was deliberately manipulated or was not the Student’s genuine attempt, the assessment may be treated as invalid and the Student may be ineligible for the Guarantee in that Assessment Group.
20. Holiday Theory Intensive
20.1 If an eligible Student satisfies all applicable requirements but does not meet the Improvement Target, Alpha One will provide one free Holiday Theory Intensive for the applicable Assessment Group.
20.2 Each Holiday Theory Intensive is:
- a five-hour live online class delivered through Zoom;
- conducted in a small-group environment similar to Alpha One’s regular classes;
- limited to qualifying Students;
- focused on re-teaching the theoretical content and assessed learning areas from the Offer Term; and
- designed to help Students apply that theory to the types of questions assessed.
20.3 The session is valued at over $150, based on the value of two standard 2.5-hour Alpha One classes.
20.4 The stated value is provided as a reasonable indication of the educational value and does not represent that the Holiday Theory Intensive is ordinarily sold separately for that price.
21. Multiple Assessment Groups
21.1 Eligibility is determined separately for each Assessment Group.
21.2 A Student who qualifies in more than one Assessment Group may attend one Holiday Theory Intensive for each qualifying group.
21.3 The maximum entitlement is one five-hour Holiday Theory Intensive per Assessment Group.
21.4 A Student participating in all four Assessment Groups may therefore qualify for up to four separate Holiday Theory Intensives.
22. Dates and attendance
22.1 Alpha One will provide one scheduled Holiday Theory Intensive for each Assessment Group.
22.2 Only one date and time will be offered for each Assessment Group.
22.3 No alternative date, makeup class, credit, refund, cash payment, transfer or substitute benefit will be provided if the Student is unavailable or fails to attend the scheduled session.
22.4 The Parent is responsible for ensuring that the Student is available at the scheduled date and time.
22.5 Alpha One will identify eligible Students and contact their Parents with the session details. A separate claim is not ordinarily required.
23. Online access and costs
23.1 The Parent is responsible for providing the Student with:
- a suitable computer or device;
- a stable internet connection;
- access to Zoom;
- a suitable learning environment; and
- any ordinary stationery or learning materials specified by Alpha One.
23.2 Alpha One is not responsible for the Parent’s internet, equipment or other participation costs.
24. Changes or cancellation by Alpha One
24.1 Alpha One may make reasonable changes to the delivery platform, tutor or operational arrangements without reducing the core five-hour educational benefit.
24.2 If Alpha One cancels a scheduled Holiday Theory Intensive or makes a material change that prevents the Student from accessing the promised benefit, Alpha One will provide a reasonable replacement session or an equivalent educational benefit of no lesser value.
24.3 Alpha One will give affected Parents reasonable notice wherever practicable.
25. Reassessment after the Intensive
25.1 After completing the five-hour Holiday Theory Intensive, the Student will be asked to complete a further assessment.
25.2 The reassessment will occur after the session, using the instructions and completion period provided by Alpha One.
25.3 The reassessment is used for educational and progress-tracking purposes.
25.4 The reassessment does not create an entitlement to another Holiday Theory Intensive or another benefit if the Student still does not meet the Improvement Target.
26. No cash redemption or transfer
26.1 The Holiday Theory Intensive cannot be exchanged for cash, a fee refund, account credit or another service.
26.2 The entitlement is personal to the qualifying Student and cannot be transferred to another Student, sibling, family or Assessment Group.
26.3 This section does not limit any refund, remedy or other right available under the Australian Consumer Law or Alpha One’s ordinary policies.
27. Other offers and Alpha One policies
27.1 The Guarantee may be combined with other Alpha One discounts and promotional offers.
27.2 Other offers remain subject to their own terms and conditions.
27.3 The Student and Parent must continue to comply with Alpha One’s ordinary enrolment, conduct, attendance, assessment, safety and technology policies.
27.4 If another Alpha One policy conflicts with these Terms specifically in relation to the Guarantee, these Terms apply to the extent of that conflict.
28. Personal information
28.1 Alpha One will collect and use personal information to:
- administer enquiries and enrolments;
- deliver the Initial, Final and reassessment tests;
- calculate Student progress;
- determine eligibility;
- communicate with Parents;
- deliver the Holiday Theory Intensive; and
- comply with legal and operational requirements.
28.2 Alpha One may disclose information to service providers that assist with the Guarantee, including FlexiQuiz, Zoom and Alpha One’s information-technology and communications providers.
28.3 Personal information will be handled in accordance with Alpha One’s privacy and policies page and applicable privacy law.
29. Outcome notification and reviews
29.1 Alpha One will ordinarily compare assessment results automatically and identify Students who did not meet the applicable Improvement Target.
29.2 Alpha One will contact the Parent of an eligible Student with the relevant Holiday Theory Intensive details.
29.3 If a Parent believes an outcome is incorrect, they may request a review by contacting Alpha One and providing:
- the Parent’s name;
- the Student’s name;
- the relevant course and Assessment Group;
- the reason for requesting the review; and
- any supporting information reasonably available.
29.4 A review request should be submitted within 30 calendar days after the outcome notification. If no notification was received, the Parent should contact Alpha One promptly after becoming aware of the issue.
29.5 Alpha One may review attendance, payment, enrolment and assessment records and may request further relevant information.
29.6 Alpha One will provide the Parent with the outcome of the review within a reasonable period.
29.7 There is no fee to request a review. The Parent is responsible for their ordinary costs of making the request, except for reasonable expenses Alpha One agrees to reimburse or is required to pay by law.
30. Australian Consumer Law
30.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
30.2 Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:
- to cancel your service contract with us; and
- to a refund for the unused portion, or to compensation for its reduced value.
You are also entitled to be compensated for any other reasonably foreseeable loss or damage.
If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
31. General provisions
31.1 Alpha One may update these Terms for future Offer Terms.
31.2 A change will not materially reduce the benefit already activated for a Student in an existing Offer Term unless the change is required by law or the Parent agrees.
31.3 If any provision of these Terms is invalid or unenforceable, the remaining provisions continue to apply.
31.4 A failure or delay by Alpha One in enforcing a provision does not waive that provision.
31.5 These Terms are governed by the laws of New South Wales, Australia. The parties submit to the courts and tribunals having jurisdiction in New South Wales, without limiting any right the Parent may have to bring a claim elsewhere under applicable consumer law.
